Boundary Disputes and Arbitration
Boundary Disputes and Arbitration Party Wall Surveyors North Wales, Chester
If you are unable to agree on a boundary position between your property and a neighbour’s property, then we can resolve the issue without the need for expensive legal costs. On average, our service is about a tenth of the cost of legal action. The process for boundary disputes resolution will be outlined to both property owners and generally follows the procedure below.
Boundary Dispute Resolution Process
A site visit is carried out to meet the property owners and gather any initial evidence. We invite both parties to submit all the evidence they think may be of value in defining the boundary position. Additional documentation may well be requested such as historic photographs which show the boundary in the background. We then carry out a desktop investigation which normally includes current and historic documents, documents held by Land Registry, online land imagery, historic maps, and Datamap Wales if applicable.
Evidence and Boundary Assessment
Further site visits may be carried out to gather physical evidence and include the use of a drone and/or plotting/recording measurements. The evidence will be analysed and presented in a full impartial report defining the boundary as accurately as possible. This is normally accepted by the owners.
If the evidence is vague and inconclusive, we offer arbitration and the negotiation of a resolution is undertaken. Failing to cooperate in this process is viewed very dimly by a magistrate should the dispute be taken to court, particularly as it is unlikely that any additional evidence is found and the costs will have escalated.
Finding a resolution to a dispute is normally a fraction of the cost of legal action and even if you are deemed to have ‘won’, it is rare to be awarded full costs.
